AGCO Deutschland GmbH ("AGCO DE") is a subsidiary of AGCO Corporation.

2. Registration
Users can register on our website by entering personal data. The data is entered into the input screen, transmitted to us and stored for pre-contractual purposes (the legal basis is Art. 6(1)(b) of the GDPR).
The following data is collected during registration:
- Optional: first name, surname
- Password
- Optional: employee number and place of work (for AGCO employees)
- Optional: Classic Club membership number
4. Order processing
The purpose of the online shop is the distance selling of merchandise. In this context, we process the data necessary for the conclusion, execution or termination of a contract with you (the legal basis is Art. 6(1)(b) of the GDPR). This includes:
- First name, surname, address, e-mail address, IP address
- Transaction numbers
- Payment method
- Order details
- Optional: title, form of address, telephone number, VAT number
We pass on information relating to your delivery address to a service or logistics company commissioned by us for the purpose of processing the sales contract. In order to ensure that the delivery of goods is in accordance with your wishes, we may pass on your e-mail address and telephone number to the company we have commissioned, which will contact you in advance to agree on the delivery details with you. The data will only be passed on for this purpose and will be deleted after delivery.
You provide us with the data necessary for the order, execution and termination of the contractual relationship between you and us. We store the data collected for the performance of the contract until the expiry of the contractual or statutory warranty rights. After these periods have expired, we store the information relating to the contractual relationship that is required under commercial/tax law for the statutory periods. During this period, the data will only be processed again in the event of an audit by the tax authorities.
We may contact you by email, telephone or via a notification in an application regarding an order, request, complaint or its delivery or processing. This communication is not for commercial purposes and you will continue to receive it even if you unsubscribe from commercial communications.
5. Payment data
During the ordering process, payment data is collected. For orders placed on our website, you can choose between different payment methods. We do not collect or store payment data ourselves. This data is collected exclusively by the service providers mentioned below.
a) Payone (credit card)
If you pay by credit card, PAYONE GmbH; Lyoner Straße 15, 60528 Frankfurt am Main, Germany, collects the following data:
- Name and address of the cardholder (optional email address)
- Payment card information (e.g. card number, CVV, expiry date)
- Transaction information (e.g. ID, date, amount, goods, item number)

b) PayPal (including purchase on account and direct debit)
It is also possible to make payment via the PayPal online payment service. PayPal allows you to make online payments to third parties. The European company operating PayPal is PayPal (Europe) S.à.r.l. & Co. S.C.A., 22-24 Boulevard Royal, 2449 Luxembourg. If you choose PayPal as your payment method, your data (required for the payment process) will be automatically transmitted to PayPal.

c) Klarna (instant bank transfer)
You can also make payment by instant bank transfer. This is a direct online bank transfer carried out by Sofort GmbH, Theresienhöhe 12, 80339 Munich. Sofort GmbH is part of the Klarna Group, a European provider of alternative payment systems.
If you choose instant bank transfer as your payment method, your data (required for the payment process) will be automatically transmitted to Klarna.

d) Paytrail (only for Finnish customers)
We offer payment via Paytrail to our Finnish customers. This is an alternative payment service provider based in Finland (Paytrail Oyj, Lutakonaukio 7, 40100 Jyväskylä). Here too, your data (required for the payment process) is automatically transferred to Paytrail.

6. Data transfer / specified purpose
We only transfer personal data to third parties to the extent necessary to fulfil our contractual obligations (in particular for the processing of a concluded contract). In connection with the provision of our website, we also pass on your data to service providers commissioned for this purpose (e.g. hosting partner, agency, etc.), who process personal data exclusively on our behalf and in accordance with our instructions. - where we process your personal information on the basis of your consent, the right to withdraw that consent;
- the right to appeal a previous decision made by AGCO regarding your privacy rights; and
- the right to lodge a complaint regarding the processing of your personal information with a competent data protection authority. This does not affect your statutory rights. You may exercise any of these rights by using AGCO's contact details. AGCO will respond to your request within the time limits prescribed by applicable laws. For complex requests, AGCO may exercise its right to extend the time limit, where appropriate. In all cases, AGCO will endeavour to respond without undue delay.
